We collect information in two ways: (i) when you provide information about yourself and (ii) automatically when you use the Service, for various purposes related to providing you the Services and products as described below.
(a) Registering for a Crackle Account. When you register to become a member of the Service, we collect your user name, email address, gender, and date of birth (collectively "Personal Information"). You may also create a profile that includes a photo and a brief message about yourself. We use your Personal Information to notify you of new product releases, to send service notifications, to customize the content and advertising you see, to fulfill your requests for products and services, to improve our services, to conduct research, and to solicit your feedback and input about the Service. In addition, if you have opted into receiving newsletters or other communications from us, we use your Personal Information for that purpose.
(b) Entering Contests and Sweepstakes. For contests, sweepstakes and other promotions conducted on or through the Service, we use the Personal Information and other personal information you choose to provide to communicate with you regarding such contest, sweepstakes or other promotion and you are deemed to consent to us sharing such Personal Information with our contest, sweepstakes or promotional partners for the purpose of administering awards.
(c) Sharing with Third Parties. Other than as set forth in this Privacy Policy, we will not share your Personal Information with third parties unless you have given us permission to do so.
(a) Usage Data. We automatically collect certain information to help us understand how our users use the Service (which we will refer to in this Privacy Policy collectively as "Usage Data"). For example, each time you use the Service we may collect your IP address or other unique identifier for the computer, mobile device, technology or other device, in part because some content is restricted to certain locations.
(b) Cookies. In addition, we use a technology called "cookies." A cookie is a piece of data that identifies you as a unique user. We use cookies to improve the quality of our Service and make the Service easier to use. We do this by storing information (for example, settings preferences) about a particular user session in cookies in order to provide you with a seamless experience during a particular session. Certain of our third-party Providers (as defined in the next paragraph) may use cookies in connection with the services they perform on our behalf. If you choose to do so, you can configure your browser to delete existing cookies or disable cookies altogether. However, certain features of the Service may not work if you delete or disable cookies.
(c) Using this Automatically Collected Information for Service Performance and Advertising. Advertising allows us to provide you the rich content available on Crackle for free. Some of our ads are based on the content of pages you are viewing elsewhere on the internet (i.e. online behavioral advertising). We believe that such tailored ads are more relevant to you and, therefore, more desirable. We also use automatically collected information for Service performance, data management and to display the appropriate content available in your country. We may contract with companies or persons to provide certain services including data management, promotional and advertising services ("Providers"). We give our Providers the information needed for them to perform these services. We also ask our Providers to abide by this Privacy Policy with respect to Usage Data or other data we share with them. Certain Providers of advertising services may use Usage Data (together with any information they collect directly from you via cookies and any information that you submit directly to them) to (a) improve, enhance and implement the sale, display and targeting of advertising on the Service and (b) combine such Usage Data with user data from their other customers to compile aggregate statistics, metrics and general trend data. You can opt out of the collection of data by certain Providers for online behavioral advertising at the Network Advertising Initiative�s opt-out page. Your use of areas of the Service that are intended for interaction with other users may reveal your user name and may allow you to publish certain personal information about you. By choosing to use these areas, you understand and agree that anyone with access to those areas may access and forward any information about you that is contained in or that you post to those areas. As with any social networking service, you should use care when disclosing your personal information to strangers. Also, the Service may permit interactions between the Service and a third party website or service, such as enabling you to "like" a product on our Service or "share" content to other websites or services. If you choose to "like" or "share" content on the Service or to otherwise post information from or via the Service to a third party's website, service, feature or application, that information will become public and the third party may have access to information about you and your use of our Services.
The Service may contain links to websites operated and maintained by third parties over which we have no control. Privacy policies on such linked websites may be different from our Privacy Policy. You access such linked websites at your own risk. Similarly, the Service may be accessed and used from third-party websites that we do not control. We have no control over the privacy policies of such third-party websites and you access such third-party websites at your own risk.
We incorporate commercially reasonable safeguards to help protect and secure your Personal Information. However, no electronic data transmission or storage of information can be guaranteed to be 100% secure. Please note that we cannot ensure or warrant the security of any information you transmit to us, and you use the Services and provide us with your information at your own risk. To help protect you and others, we may monitor your use of the Services and use your Personal Information, Usage Data and/or other information we collect in order to: identify fraudulent activities and transactions; prevent abuse of and investigate and/or prosecute potential threats to or misuse of the Services; ensure compliance with the Terms of Use and this Privacy Policy; investigate violations of or enforce these agreements; and protect the rights and property of you, Crackle, its partners and other customers. This security monitoring may result in the collection, recording, and analysis of online activity or communications through the Services. If you do not consent to these conditions, you must discontinue your use of the Services.
The Service is a general audience website and application, and we do not knowingly collect personally identifiable information from children under the age of 13. If we become aware that we have inadvertently received personally identifiable information from a user under the age of 13, we will delete such information from our records. Because we do not knowingly collect any personally identifiable information from children under the age of 13, we also do not knowingly distribute such information to third parties.
Pursuant to California Civil Code Section 1798.83, Crackle has a comprehensive privacy policy that sets forth that Crackle only shares personal information with third parties for direct marketing purposes if you specifically opt-in or are offered the opportunity to opt-out and elect not to opt-out to such sharing at the time you provide personal information or at the time you choose to participate in a feature on the Service. If you do not opt-in or if you opt-out at that time, Crackle does not share your information with that identified third party for marketing purposes.
California Business & Professions Code Section 22575(b) (as amended effective January 1, 2014) provides that California residents are entitled to know how Crackle responds to "Do Not Track" browser settings. Like many other websites and online services, Crackle does not currently alter its practices when it receives Do Not Track signals because there is no consensus among industry participants as to what "Do Not Track" means in this context. In addition, California residents are entitled to know that third parties may collect personal information about your online activities over time and across different websites when you visit the Service. The Services are operated in the United States. If you are located in the European Union, Canada or elsewhere outside of the United States, please be aware that information we collect will be transferred to and processed in the United States. By using the Services, or providing us with any information, you consent to this transfer, processing and storage of your information in the United States, a jurisdiction in which the privacy laws may not be as comprehensive as those in the country where you reside and/or are a citizen.
Crackle may, in its sole and absolute discretion, change this Privacy Policy from time to time. In case of any material change to this Privacy Policy, we will replace the "Privacy" link on our home page with a link entitled "Privacy: Updated" for no less than 30 days. All changes to the Privacy Policy will be effective when posted, and your continued use of the Service after the posting will constitute acceptance of, and agreement to be bound by, those changes. If you object to any such changes, your sole recourse shall be to cease using the Service. However, if we make any change that allows us to use your Personal Information in any materially different manner than we were permitted under the Privacy Policy in effect at the time you submitted such Personal Information, we will obtain your consent before making such materially different use.
